1. About The Service

The Vibe Video is an online platform that allows registered users to create, edit, manage, and publish short-form videos using AI-assisted tools. Videos can be generated from text prompts, uploaded media, and stock assets sourced through our licensed third-party providers.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

2. Eligibility

You must be at least 18 years old to create an account and use the service. By registering you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete. If you register on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@thevibevideo.com if you become aware of any unauthorised access to your account.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, are being used fraudulently, or are otherwise in violation of these Terms.

4. Acceptable Use

You agree to use the service only for lawful purposes and in a manner consistent with these Terms. You must not:

• Use the service to create, publish, or distribute content that is illegal, defamatory, harassing, obscene, or fraudulent.
• Upload or incorporate content that infringes the intellectual property rights of any third party.
• Impersonate any person, company, or entity, or misrepresent your affiliation with any person or entity.
• Use automated tools, bots, or scripts to access or use the service in a way that places excessive load on our infrastructure.
• Attempt to reverse engineer, decompile, or extract the source code of any part of our platform.
• Circumvent or attempt to circumvent any access controls, security measures, or usage limits.
• Resell, sublicense, or commercially redistribute the service without our prior written consent.

5. User Content and Ownership

You retain all ownership rights to the original content you upload to the platform (such as images, audio files, and scripts). By uploading content you grant us a non-exclusive, worldwide, royalty-free licence to store, process, and display that content solely for the purpose of providing the service to you.

You also retain ownership of the final videos you generate, subject to the licences covering any third-party stock assets or AI-generated elements incorporated into those videos, as described in Section 6 below.

We do not claim ownership over your generated videos. However, we may use anonymised, aggregated data about platform usage to improve our service.

6. Third-Party Assets and Stock Content

Videos generated through our platform may incorporate stock footage, music, images, or AI-generated media sourced from our licensed third-party providers. The use of such assets is governed by those providers' licence terms, which are incorporated into these Terms by reference. By using the service you agree to comply with those licence terms.

It is your responsibility to ensure that any final video you publish or distribute complies with the applicable asset licences. We are not responsible for any licence violations arising from your use or distribution of generated videos beyond the permitted scope.

7. Copyright and Intellectual Property — User Responsibility

You are solely and fully responsible for ensuring that all content you upload, submit, or incorporate into a video — including but not limited to images, audio, music, logos, trademarks, text, and footage — does not infringe the copyright, trademark, or other intellectual property rights of any third party.

You represent, warrant, and covenant that you own, or hold all valid licences, rights, consents, and permissions necessary to use and authorise us to process every element of content you submit to the service. You bear sole and exclusive legal responsibility for any content you create, upload, generate, or publish through the platform, and for all consequences arising from it.

The Vibe Video does not review, pre-screen, or verify the licensing status of content you provide. We are not responsible for, and expressly disclaim all liability arising from, your use of any content that you do not have the legal right to use.

This includes, without limitation:

• Uploading music, sound recordings, or compositions without a valid licence or the rights holder's permission.
• Incorporating copyrighted images, photographs, or artwork without authorisation.
• Using footage, film clips, or video recordings owned by third parties without a valid licence.
• Including brand names, logos, or trademarks in a manner that is not permitted by the rights holder.
• Reproducing written content, scripts, or dialogue protected by copyright.
• Using the likeness, voice, name, or persona of any real individual without their explicit consent.

Where the service produces AI-generated or AI-assisted media, you acknowledge that you are responsible for reviewing the output before publishing it and for confirming that it does not infringe any third-party right or violate any applicable law. We make no representation that AI-generated output is free of third-party rights or fit for publication.

If a third party brings a claim against us arising from content you uploaded, generated, or used without authorisation, you agree to fully indemnify and hold us harmless from all damages, costs, and legal fees incurred as a result. See Section 13 (Indemnification) for details.

We comply with the Digital Millennium Copyright Act (DMCA) and equivalent legislation. If you believe that content on our platform infringes your copyright, please send a written notice to legal@thevibevideo.com including a description of the copyrighted work, the location of the allegedly infringing material, your contact information, and a statement made under penalty of perjury that you are authorised to act on behalf of the rights holder. We will investigate and, where appropriate, remove the material and terminate repeat infringers in accordance with our repeat-infringer policy.

8. Social Media Publishing

If you connect a social media account (such as a Facebook Page) and use our platform to publish videos, you are solely responsible for the content of those publications and for ensuring they comply with the terms of service of the relevant social media platform.

We act only as a technical intermediary at your explicit request. We are not responsible for any action taken by a social media platform against your account, including removal of content, suspension, or termination, arising from videos you publish through our service.

9. Subscriptions and Payments

Certain features of the service require a paid subscription. By purchasing a subscription you agree to pay the applicable fees as described on our Pricing page. All fees are exclusive of applicable taxes, which will be added where required by law.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period; we do not provide partial refunds for unused time within a billing period, except where required by applicable law.

We reserve the right to change pricing with at least 30 days' notice. Continued use of the service after a price change takes effect constitutes your acceptance of the new price.

10. Prohibited and Illegal Content

You must not use the service to create, generate, store, publish, or distribute any content that is illegal under any applicable law, or that contains:

• Sexually explicit or pornographic material.
• Any material that sexualises, exploits, or endangers minors, including child sexual abuse material (CSAM) — which we report to the relevant authorities as required by law.
• Content that promotes, glorifies, or facilitates violence, terrorism, self-harm, or hate speech based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Misinformation, deepfakes, or synthetic media designed to deceive, impersonate, or defame a real person, or to interfere with elections or public safety.
• Content that facilitates illegal activity, including the sale of illegal goods or services, fraud, money laundering, or the distribution of malware.
• Spam, phishing material, or content designed to defraud, scam, or mislead viewers.
• Content that violates the privacy, publicity, or data-protection rights of any individual.

You acknowledge that you alone bear all legal responsibility and consequences — civil and criminal — for any illegal content you create or distribute through the service. We do not condone, authorise, or accept liability for such use.

We reserve the right, but assume no obligation, to monitor, review, remove, or disable access to any content that violates this section, and to suspend or terminate the accounts responsible without notice and without refund. Where required by law, we will cooperate with law enforcement and disclose information relating to suspected illegal activity.

11. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

AI-generated video content may not always meet your expectations. We do not guarantee the quality, accuracy, or suitability of any generated output for any specific purpose.

12. Limitation of Liability

To the maximum extent permitted by applicable law, The Vibe Video and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the service.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) the fees you paid to us in the three months preceding the claim, or (b) one hundred US dollars (USD $100).

13. Indemnification

You agree to indemnify, defend, and hold harmless The Vibe Video, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the service in violation of these Terms.
• Any content you upload, submit, or generate using the service, including any copyright or intellectual property infringement.
• Your publication of videos to any social media platform through our service.
• Any misrepresentation made by you in connection with your use of the service.

14. Termination

You may close your account at any time through your account settings or by contacting us. We may suspend or terminate your account at our discretion if we believe you have violated these Terms, with or without prior notice depending on the severity of the violation.

Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination — including Sections 5, 7, 12, 13, and 16 — will remain in effect.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will notify you by email or by displaying a prominent notice in the app at least 14 days before the change takes effect. Your continued use of the service after the effective date constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which The Vibe Video is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
